More Merger News: GEORGETOWN PARTNERS files complaint with FCC

This is becoming a weekly occurrence.

The latest complaint about the Sirius Xm Merger comes from a company called GEORGETOWN PARTNERS.
This is the company that wants 20% of the Satellite Radio infrastructure handed over to them.

In the PDF GEORGETOWN PARTNERS calls the Sirius XM ‘A La Carte’ option a “Fairytale”:

A review of thefiling exposes the Sirius-XM so-called “A La Carte” proposal to be nothing more than a“fairytale” with the potential to in fact have a disturbingly unhappy ending for the public.

They go on to say:

I. THE TYPE OF “A LA CARTE” PUT FORTH BY SIRIUS AND XM IS AFAIRYTALE WITH NO PUBLIC INTEREST BENEFITGeorgetown Partners LLC (“Georgetown”) recognizes and agrees that a la carteofferings benefit consumers in that consumers may select and purchase programming oftheir choice as opposed to being required to buy entire packages of programming thatmay include unwanted channels. The Sirius-XM January 22 FCC filing gives theimpression that they have an a la carte offering that will be available to owners of Siriusand XM receivers if the FCC approves its proposed merger. In an attempt to further“spin” this deception, Sirius-XM state that their alleged “A La Carte” offerings includetwo different choices in pricing, “A La Carte I” and “A La Carte II”, to create theimpression that the offerings are available now and that they will be rolled out in shortorder. Nothing could be further from the truth. Sirius-XM know full well that the “A LaCarte” offerings they describe will only be available on so-called “next generation”1satellite radios that do not exist and for which there are no production plans. The Sirius-XM “A La Carte” offerings are a “fairytale.” There are no public interest benefits in thenear or even in the intermediate future.Unfortunately, this “fairytale” does not have a happy ending. Even assuming thatsometime in the distant future these radios were actually to be produced and could bepurchased, the more than 30 million present owners of installed automobile satellite radioreceivers and the tens of million of future car owners of such radios would have to ripthese radios out of their dash boards, junk them, and pay whatever monopoly price thepost-merger company would charge for the “next generation” radios.Furthermore, Sirius-XM have made no guarantee that “A La Carte,” whenever it
might become available, will be a permanent option for consumers. Furthermore, even
though the companies have put proposed pricing structures in their earlier filings, they
offer no guarantees on pricing, on how long these packages will be available, or on what
content these packages will include. In fact, no guarantees of any kind are made. Perhaps
Sirius-XM feel they do not need to make guarantees because after the merger they
basically will be free from any ongoing regulatory oversight.
Rather than focusing on obvious attempts to put one over on the FCC and the
American consumer by “marketing” through its filing an illusory “A La Carte” offering,
Sirius-XM should withdraw this misleading and disingenuous January 22 filing and
submit a filing with a real a la carte offering that benefits the consumer.

I really don’t feel like quoting the rest of the Complaint so you can read it at the link below.

When are people going to just give up and let this merger happen? How long is the FCC going to let this drag on for?
Maybe we will see the merger by 2009…..but by then one of these companies will probably be Bankrupt.

HD Radio Alliance Against Satellite Radio Merger

Does anyone listen to HD radio?

Seriously….is Satellite Radio really that much of a competition?

These guys need to grow up and quit complaining and whining.

The HD Digital Radio Alliance has filed a complaint with the FCC,
officially opposing the proposed satellite radio merger. The
organization reiterated its position that satellite radio receivers
should also be equipped with the ability to tune in HD Radio stations
as well.

In a letter sent to the FCC late
last week, the Alliance again says that adding HD Radio capability to
satcaster receivers should be a requirement of the merger, as should
the termination of any exclusivity agreements with retailers and
automakers. The Alliance adds that an XM/Sirius
merger would reduce consumer choices and at this point, HD Radio
“cannot be considered a competitive alternative to satellite radio.”
They add that a merger would also “make it more difficult for HD Radio
to expand consumer choices.”

The letter
also goes into detail about the satcasters’ relationship with
automakers and says that “while XM and Sirius have already become
entrenched, HD Radio is at the early stages of adoption in the most
important distribution channel for…radio.”

SIRIUS Satellite Radio Hosts Gay Presidential Caucus

Representatives and Supporters for Clinton, Obama, Edwards Campaigns Vie for the Gay Community’s Vote on SIRIUS OutQ

SIRIUS Satellite Radio announced today it will hold its
first ever Lesbian, Gay, Bisexual and Transgender presidential caucus
on January 31, 2008 from 3:00 - 5:00 pm ET on The Michelangelo
Signorile Show on SIRIUS OutQ, the nation’s only 24/7 LGBT radio
channel. Representatives and supporters for Hillary Clinton, Barack
Obama and John Edwards will share their candidates’ platforms and
views, take questions from callers, and engage in an open dialogue with
SIRIUS’ national audience.

Signorile’s show — spanning politics, media, and popular culture
and how it affects the LGBT community — is further representation of
SIRIUS’ broad, diversified commitment to covering the 2008 presidential
campaign. The Michelangelo Signorile Show airs Monday - Friday from
2:00 - 6:00 pm ET on SIRIUS OutQ channel 109. The show features
newsmakers, community leaders, and highlights the many voices of the
LGBT community. In addition to The Michelangelo Signorile Show, SIRIUS

the LGBT Caucus, Hilary Rosen will support Senator Clinton. She is the

Senator Obama. Corbin is the National LGBT Liaison for the Obama

Campaign from 1996-2003, and served as HRC Finance Committee Co-Chair

John Edwards for President Campaign. Stern is an attorney, educator,
and social activist who worked for more than a decade on numerous
Democratic campaigns and in the movement for social justice and

ESPN and XM Satellite Radio to Launch ‘ESPN Xtra’ Radio Channel

ESPN and XM Satellite Radio today announced that XM will add a new
slate of ESPN programs to its line up starting February 4 featuring a
new ESPN Radio-dedicated channel.

XM and ESPN will re-brand XM channel 141 as ESPN Xtra. This channel
will enhance its current schedule of ESPNEWS programming with new shows
and specials, including three of ESPN Radio’s premier talk programs
from its owned stations in New York and Dallas, which will be available
for the first time for a national radio audience only on XM.

The ESPN Xtra channel will also air content produced by ESPN
exclusively for XM throughout the year, live coverage of events ranging
from the X Games to the ESPY Awards, and ESPN columnist Bill Simmons’
popular podcast from ESPN.com. In addition to the newly branded ESPN
Xtra channel, XM will continue to offer ESPN Radio (XM channel 140).

“ESPN is the most popular brand name in sports, and XM is the
nation’s leading satellite radio company,” said Eric Logan, XM
executive vice president, programming. “ESPN has been an integral
partner of XM since the day XM started broadcasting in 2001. Now we’re
going to be bringing some of the best sports talk shows from ESPN Radio
stations to millions of new listeners across the country, as well as
ESPN specials that you can only hear on XM. This new channel — ESPN
Xtra — is another important milestone in our partnership with ESPN.”

Traug Keller, ESPN senior vice president, production, business
divisions, said, “We are excited about our expanded relationship with

The Michael Kay Show and The Max Kellerman Show from 1050 AM ESPN
Radio in New York and Galloway and Company from 103.3 FM ESPN Radio in
Dallas will be heard nationwide on the ESPN Xtra channel, marking the
first time that these programs will be aired nationwide.

The Michael Kay Show will be heard weekdays on the ESPN Xtra channel
from 4 p.m. to 7 p.m. ET. In addition to hosting the radio show, Kay
serves as television play-by-play announcer for the New York Yankees
and the host of Centerstage on the YES Network.

The Max Kellerman Show will air on ESPN Xtra weekdays from 10 a.m.
to 1 p.m. Kellerman is also an analyst for HBO Boxing and is well known
for his hosting stints on ESPN2, Fox Sports Net, and Spike TV.

Galloway and Company, hosted by Randy Galloway, will be carried on
ESPN Xtra weekdays from 7 p.m. to 10 p.m. Galloway has been a radio
talk show host for 21 years, and he writes a newspaper column for the
Fort Worth Star-Telegram.

ESPN Xtra specials will include an in-depth Major League Baseball
preview in advance of Opening Day. This special comes on the heels of
December’s BCS preview special hosted by ESPN’s Colin Cowherd that ESPN
created for XM.

Bill Simmons, a.k.a. “The Sports Guy,” is a columnist for ESPN.com’s
“Page 2″ and ESPN The Magazine. The New England native, renowned for
his passion for Boston sports teams, will be heard Fridays at 3 p.m.
and at 10 p.m. ET when ESPN Xtra airs his popular 40-minute podcast
from ESPN.com.

National Council of Negro Women Oppose Merger, Send Letter to FCC

What does the National Council of Negro Women have to do with a Satellite Radio Merger?

This is just getting out of hand.

The National Council of Negro Women submitted a letter to the FCC yesterday stating the following:

On behalf of the NCNW an organization representing over four million African-American women
worldwide and dedicated to championing civil rights and equality for all people, I must convey to the
FCC and you the Council’s strong and considered concern that the proposed transaction between
Sirius Satellite Radio and Xm Satellite Radio Holdings pose clear, present and unmitigated
threat to decency and greater diversity of media ownership.

Ok…what does any of this have to do with anything? No one is forcing you to listen to Satellite
Radio? Isn’t this the same as Pay Per View TV or Stations like HBO? This is just a bunch of
nonsense. They are just looking for attention.

It gets better:

One only has to evaluate the current programming now offered by Sirius and XM to recognize that our concerns and fears are well founded, Programming such as Howard Stern, Opie and Anthony, and Bubba the Love Sponge - which help to perpetuate racist and sexist stereotypes in our culture - drive the business of both companies.

Jesus, don’t fucking listen to it if you don’t like it. There are Hundreds of other stations to listen to.
You do know there is an Oprah Station?

A Sirius - XM satellite radio monopoly will focus it (sic) resources on only its most profitable audiences, with more of the same lowest-common-denominator programming of the Howard Stern variety.

And it keeps going on and on…….and on….
